Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to F.No.T-3/6/SZ/C/2007 (NMC) dated 06.07.2007, lying on the file of the respondent and quash the same as illegal and direct the respondent not to proceed against the petitioner as the same was closed by the Settlement Commission.

O R D E R

The relief sought for in this writ petition is to call for the records pertaining to F.No.T-3/6/SZ/C/2007 (NMC) dated 06.07.2007 lying on the file of the respondent and quash the same as illegal and direct the respondent not to proceed against the petitioner as the same was closed by the Settlement Commission.

2.The learned counsel for the petitioner submits that the writ petition was filed in July, 2007. The department has not initiated any proceedings, pursuant to the impugned summons. Hence, the learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition with liberty to approach this Court if advised.

3.Hence, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach this Court as and when required. No costs. Consequently, connected miscellaneous petition is closed.
