ORDER

This Contempt Petition has been filed seeking to punish the respondent for wilful disobedience of the order dated 01.06.2023 passed by this Court in Crl.O.P.No.12261 of 2023.

When the matter was taken up for hearing today, there was no representation for the petitioner either in person or through counsel. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the complaint pertains to the alleged missing of 29 sovereigns of gold jewels from the house of the petitioner. Based on the said complaint, a case in Crime No.109 of 2022 was registered by the respondent Police for the offence punishable under Section 380 of IPC. The petitioner had filed Crl.O.P.No.12261 of 2023 before this Court seeking a direction to the respondent to file the final report within a stipulated time. This Court, by an order dated 01.06.2023, directed the respondent Police to complete the investigation and file the final report within a period of two months. Thereafter, the Inspector of Police, Thiru.R.Rajan, conducted a thorough, elaborate and detailed investigation.

Upon completion of the investigation and based on the statements of the witnesses and available material evidences, the case was closed as 'undetectable' and the final report has been e-filed before the learned Judicial Magistsrate, Namakkal on 10.06.2024. R.C.S.No.57 of 2024 has been assigned and it has been served on the petitioner by Registered Post. He further submitted that the respondent Police had taken all possible steps to trace the culprits and that there was no wilful delay or lethargy on the part of the respondent Police in conducting the investigation.

Taking into consideration the fact that the final report has been filed and the order of this Court dated 01.06.2023 has been complied with, this Contempt Petition stands closed. The presence of Mrs.M.Sreeja, the Inspector of Police, who registered the case and Mr.R.Rajan, who completed the investigation, is recorded.
