Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the 3rd respondent to register the Deed of Sale dated 05.03.2015 executed by V.Lakshmi Kanthamma in favour of the petitioner, presented on 09.30.2015 which was assigned as P22 of 2015 and consequently direct him to release the document so registered and issue Certificate of Registration to the petitioner in respect of the said Sale Deed.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner would state that his vendor, namely, V.Lakshmi Kanthamma, came forward to execute a registered Sale Deed in respect of 1/3rd Undivided Share of the lands out of an extent of 10 acres 57 cents comprised in various survey numbers of Thervazhi Village and Athupakkam Village, Gummidipoondi, Thiruvallur District and it was presented for registration on 09.03.2015 after complying with all procedural formalities and the receipt to that effect has also been issued vide Receipt No.2015443 dated 09.03.2015 and also assigned with pending Document No. P201500022.

The learned counsel for the petitioner would submit that though the document was received as early as on 09.03.2015, it was neither registered nor returned and in this regard, the petitioner has also submitted a representation dated 09.10.2015 to the 2nd respondent, who in turn, vide letter No.516/Aa1/2016 dated 25.01.2016, has directed the 3rd respondent to submit a detailed report as to the pending Document No.P201500022 and despite that, the 3rd respondent is keeping quiet and since nothing is forthcoming, the petitioner came forward to file the present writ petition. This Court heard the submissions of the learned counsel for the petitioner and Mr.V.S.Ramesh, learned Government Advocate, who accepts notice on behalf of the respondents.

Though the petitioner has prayed for a larger relief, this Court in the light of the facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the 3rd respondent to act on the communication of the 2nd respondent dated 25.01.2016 in Letter No.516/Aa1/2016 as well as the representation of the petitioner dated 09.10.2015, in accordance with law and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The writ petition is disposed of accordingly. No costs.
