The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 35, 35(B) of the Indian Forest Act read with Rule 9 of the Tamil Nadu Timber Transit Rules 1968, in Crime No.1 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 82 Red Wood Pieces and its total weight is 2007 Kg. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide any stringent conditions that may imposed on him. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that this is the second anticipatory bail petition. Earlier anticipatory bail petition filed by the petitioner before this Court in Crl.O.P.No.14223 of 2022 was dismissed on 21.06.2022. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, this Court had dismissed the earlier anticipatory bail petition and now again he has filed a petition seeking anticipatory bail. There is no change of circumstances to entertain the second anticipatory bail petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
