ORDER

This Civil Revision Petition has been filed, seeking for a limited relief.

2. The petitioner seeks for early disposal of the suit, O.S. No. 78 of 2024, on the file of the District Munsif-cum-Judicial Magistrate, Denkanikottai. The petitioner is the second defendant in the suit, O.S. No. 78 of 2024. According to the petitioner, a false and vexatious suit has been filed by the plaintiff against the petitioner / second defendant. According to the petitioner, there is no progress shown in the suit, as the suit is pending for framing of issues for a very long time.

3. The learned counsel for the petitioner also drew the attention of this Court to the various proceedings of the Trial Court and would point out that the suit is pending for framing of issues from 15.04.2025 onwards. The petitioner also claims that, for the very same purpose, another suit has also been filed by the very same plaintiff against the petitioner, which is also pending. Therefore, the petitioner seeks for early disposal of the suit in O.S. No. 78 of 2024.

4. This Court is not expressing any opinion on the merits of the petitioner's case in this Civil Revision Petition. However, no prejudice would be caused to any of the parties if a direction is issued to the Trial Court to dispose of the suit, O.S. No. 78 of 2024, within a time frame to be fixed by this Court.

5. Since no adverse orders are passed against the respondents in this Civil Revision Petition, notice to the respondents is dispensed with by this Court.

6. For the foregoing reasons, this Court directs the District Munsif-cumJudicial Magistrate, Denkanikottai, to frame the issues in O.S. No. 78 of 2024 within a period of four weeks from the date of receipt of a copy of this order. After framing the issues within the stipulated time, the District Munsif-cumJudicial Magistrate is directed to dispose of the suit, O.S. No. 78 of 2024, within a period of eight months thereafter.
