Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus to call for the records order passed by the 1st respondent in vide impugned order Pa.Mu.6487/2021/Pa2 dated 25.07.2022 and quash the same as illegal and consequently direct the 1st respondent to revive the patta Nos.225, 643 and 1586 of the petitioners situated at Thadangam, Dharmapuri District.

ORDER

This Writ Petition is filed seeking a issue a writ of Certiorarified Mandamus to call for the records of the order passed by the 1st respondent in impugned order Pa.Mu.6487/2021/Pa2, dated 25.07.2022 and quash the same as illegal and consequently direct the 1st respondent to revive the patta Nos.225, 643, 1586 of the petitioners situated at Thadangam, Dharmapuri District.

2. Heard and perused the materials available on record.

Though the learned counsel for the petitioners submitted that the Civil Suit which is already pending is only for partition and the same is nothing to do with the present impugned order, the learned counsel herself admitted that there is a dispute regarding title and she is asking the revenue authorities to declare the title. It is made clear that the revenue authorities 2/4

have no authority to declare the title or grant title. Therefore, this Court does not find any perversity or infirmity in the impugned order. Since already civil suit is pending, the petitioners can work out their remedy before the Civil Court in the manner known to law.

4. With the above observations, this Writ Petition is dismissed. Consequently, connected Miscellaneous Petition in CMP No.29863 of 2023 is closed.
