ORDER

The petitioners apprehend arrest for the alleged offences under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 and 3(1) of Prevention of Damage to Public Property Act, 1984 in Crime No.137 of 2026 on the file of the respondent police seek anticipatory bail.

2. The allegation against the petitioners is that on 10.05.2026, a wordy altercation arose during the celebration of the election victory. When the defacto complainant intervened, the first petitioner allegedly abused and assaulted him with a wooden stick. Thereafter, the petitioners allegedly followed him to his house, criminally intimidated him, and caused damage to the house. Hence, a case has been registered against the petitioners.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. He further submitted that they are ready to abide by any conditions that may be imposed by this Court and

that they are ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioners.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioners have previous cases pending against them. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given my anxious consideration to either side submissions.

6. Considering the nature of the allegations and the antecedents of the petitioners, this Court is not inclined to enlarge the petitioners on anticipatory bail.
