ORDER

The petitioner apprehends arrest for the alleged offence punishable under Sections 303 of BNS Act 2023 r/w under Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.305 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with other accused was involved in illegal transportation of 3 unit of gravel sand in a lorry, without any valid permission. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and, on instructions, submitted that 3 units of gravel sand had been illegally transported and that the petitioner has four previous cases pending against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the allegation and the fact that the petitioner has four previous cases, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
