ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable u/s 191(3), 296(b), 115(1), 118(2), 109(2) and 351(2) of BNS r/w Section 3(1) of PPDL Act, 1992, in Crime No.140 of 2025, seek anticipatory bail.

2. The case of the prosecution is that the petitioners have abused the husband of the defacto complainant with filthy language and attacked him with knife and wooden log, due to which, he sustained grievous injuries. Hence, the complaint.

3. The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and due to previous enmity, they have been falsely implicated in this case. He further submitted that custodial interrogation of the petitioners are not required. Further, he submitted that the petitioners are ready and willing to abide by any stringent conditions as imposed by this Court. Hence, he prays for anticipatory bail to the petitioners.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners are having previous cases against them. Hence, he vehemently opposed for grant of anticipatory bail to the petitioners.

5. Heard the learned counsels on either side and perused the records.

6. Since the petitioners have committed very serious offence and are having previous cases, the custodial interrogation of the petitioners is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
