The petitioner herein is the named accused in Crime No.142 of 2019 taking advantage of quashing the case in respect of few other accused whose names not found in the FIR or no specific overt act attributed by the witnesses, the present quash petition has been filed. However on reading the FIR, the statement of the defacto complainant, this Court found that the petitioner was present with the other accused persons with the defacto complainant was waylaid and extracted money showing knife.

2. In the light of the above submissions, this Court finds no merits to quash the proceedings in PRC.No.4 of 2022 on the file of the District Munsif cum Judicial Magistrate Court at Gummidipoondi, Thiruvallur District. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 08.07.2024 Index : Yes/No ub 2/4
