Petitioner seeks bail, since he was arrested on execution of Non Bailable Warrant issued due to his non-appearance. The date of execution of Non Bailable Warrant is 25.01.2023. Due to his abscondance, there is no progress in the trial.

2. The learned Additional Public Prosecutor states that, the learned Principal Sessions Judge, Chennai made over the case to the learned V Additional Sessions Judge, Chennai on 30.11.2022. Since then, petitioner did not appeared before the trial Court and thereafter Non Bailable Warrant was issued on 25.01.2023 and the same was executed on 11.07.2023 . He further submits that the matter is posted on 12.09.2023 for framing of charges.

3.Considering the facts and the case status, this Court is of the view that, petitioner may approach the trial Court after 12.09.2023, the date on which the case is posted for framing of charges and on such filing, the trial Court shall consider the bail petition on merits. 1/2 https://www.mhc.tn.gov.in/judis
