PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the 1st respondent herein to consider the petitioners representation dated 13.05.2025 sent for rectifying the mistake occurred during UDR Scheme in respect of the petitioners lands measuring 4.11 acres in S.F.No.546/2 situated at Alekotta Village, Soolagiri Taluk, Krishnagiri District, in accordance with law and within a stipulated period.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the respondents 4 to 16 is dispensed with.

The present writ petition is filed praying for a writ of mandamus, to direct the 1st respondent to consider the petitioners representation dated 13.05.2025 whereby they had sought for rectification of mistakes which had occurred during UDR Scheme in respect of the lands comprised in S.F.No.546/2 3/7
measuring an extent of 4.11 acres, situated at Alekotta Village, Soolagiri Taluk, Krishnagiri District.

It is submitted by the learned counsel for the petitioner that the subject property originally was in possession and enjoyment of the petitioners' grandfather Nanjundappa and he died intestate on 11.02.1984 leaving behind his sons Mallappa (petitioners' father), Gurumurthy, Krishnappa and daughters Parvathamma and Savithramma. The petitioners father died on 29.05.2022 while Gurumurthy died on 19.01.2024, Parvathamma died on 29.03.2000 and Krishnappa died as Bachelor on 01.03.2015. It is stated that petitioners are the lone surviving Legal Heirs of Late Mallappa. The petitioners, with a proposal to partition the subject property by metes and bounds. It was found that their lands comprised in S.F.No.546/2 had been sub-divided as S.F.Nos.546/2B, 546/2D, 546/2E and 546/2F and the Pattas were issued in the names of Kurappa, Ramayya, Puttayya and Kurappa respectively.
3.1. It is further submitted by the learned counsel for the petitioner that originally patta stood in the name of the petitioners' grandfather Nanjundappa. It is further submitted that the names of Kurappa, Ramayya and Puttayya have been 4/7
wrongly entered into the patta during UDR Scheme. In view thereof, to rectify the errors occurred during UDR Scheme, the petitioners made a representation to 1st to 3rd respondents on 13.05.2025, which is said to be pending. Hence, the present writ petition has been filed before this Court.

At the outset, it is submitted by the learned Special Government Pleader for the 1st to 3rd respondents that the representation dated 13.05.2025, made by the petitioners would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioners.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the 1st respondent, to consider the representation dated 13.05.2025 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioners, the private respondents and any other interested persons/stake holders, within a period of sixteen (16) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits 5/7
