C.M.P.Nos. 14500 & 14495 of 2022 in S.A. Nos. 94 & 157 of 2014 T.V. THAMILSELVI, J.

These Civil Miscellaneous Petitions have been filed seeking to bring on record the proposed respondents 7 to 12 herein as legal representatives of deceased 3rd respondent in both the above Second Appeals respectively.

2. Mr.S.Gopinathan, learned counsel for petitioner/appellant submitted that pending appeal, the 3rd respondent died on 04.07.2022. He would submit that the proposed respondents are necessary parties in place of 3rd respondent as his legal heirs to proceed further in the present second appeals. Hence, he has filed the above petitions and prayed to allow the same.

3. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, these petitions are allowed. The proposed legal representatives of the 3rd respondent are impleaded as respondents 7 to 12 in both the above Second Appeals respectively.

4. Further, the learned counsel for petitioners would submit that a petition in C.M.P.SR.No. 96320 of 2022 was filed to appoint advocate commissioner and prayed that the same may be posted for hearing.

5. The Registry is directed to carry out the necessary amendment in the cause title of both the Second Appeals respectively and to number the petition in C.M.P. SR. No. 96320 of 2022 if it is otherwise found to be in order. Post the matters on 07.09.2022.
