Veera @ Veerabathiran v. State Rep By Its The Inspector Of Police
Crl.O.P.No.17753 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Veera @ Veerabathiran, who was arrested and remanded to judicial custody on 31.05.2023 for the offences punishable under Sections 147, 148, 341, 302, 120(B) of IPC & Section 5 of Explosive Substances Act in Crime No.77 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has no connection with the alleged murder concerned in Crime No. 77 of 2023. Infact, petitioner was seriously attacked in another incident and suffered injuries on his head, face and on his right hand. Surgery was also conducted on 29.04.2023. Even during his judicial custody, he has been taken to Stanley Hospital for treatment. Petitioner is in Judicial Custody from 31.05.2023. Thus, he seeks bail to the petitioner.
3. The learned Additional Public Prosecutor submitted that, deceased, who is the husband of the defacto complainant belongs to a political party and runs scrap business. There was a political rivalry between the 1st accused and the deceased, for which, 1st accused along 1/5
with other accused, especially the petitioner had conspired to do away with the deceased. In consequence of the conspiracy, on 27.04.2023, accused persons came in two cars and blocked the deceased car near Nazarethpet Bus Stop and hurled country made bombs over the deceased and tried to assault the deceased. Deceased tried to escape and run towards Varadharajapuram to save his life. However, accused in this case had gone after him and attacked him indiscriminately with a knife and other deadly weapons on his head and other parts of the body. As a result, he died. Though, investigation in this case is completed and final report is filed in S.C.No.165 of 2023, he vehemently objects this petition on the ground that, petitioner is the main conspirator in the murder of the deceased and there are 10 previous cases pending against the petitioner. Though, investigation in this case is completed and final report is filed, considering the allegation against the petitioner that, petitioner is the main conspirator in the murder of the deceased and also considering that, there are multiple previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner for the 3/5
reason that, if the petitioner is released on bail, there is a possibility that petitioner may threaten the witnesses and tamper the evidence.
