Orders reserved on : 06.02.2023 Orders pronounced on : 01.06.2023 J.NISHA BANU, J., These miscellaneous petitions have been filed to set aside the order dated 17.12.2020, dismissing the Writ Petitions for non prosecution and to restore the Writ Petitions on file.

2.Both the Writ Petitions are filed by the same petitioner, for the reliefs of quashing the notification dated 29.06.2007 in No.A/2/2/1/PIPMATE/A1/2007 /Part File-I and to absorb the petitioner in the post of Lecturer in Architectural Assistanship with effect from 13.01.2000. 3.From the year 2007, these matters are adjourned, on many occasions and finally, when the matters were listed for hearing, this Court has observed as follows:- "The learned counsel for the petitioner is not ready due to lethargic attitude. In order to give one more opportunity to the petitioner, post the matter on 17.12.2020. No further time will be granted." 4.Accordingly, the matter was listed on 17.12.2020 and on that date, the Page No:1/4

petitioner counsel was not present. Therefore, the Writ Petitions were dismissed for non-prosecution.

5.Thereafter, the petitioner has filed the present miscellaneous petitions to restore the Writ Petitions and after a period of 2 years, the restoration petitions have been listed before this Court, for hearing on 29.11.2022. Even thereafter, the matters were adjourned either at the instance of the petitioner or at the instance of the respondents.

6.Admittedly, the Writ Petitions are of the year 2007. At the time of filing the Writ Petitions, petitioner was aged about 42 years and by this time, she might have reached the age of 58 years and above. On perusal of records, it is seen that right from the date of filing of these Writ Petitions, these matters were adjourned either at the instance of the petitioner or at the instance of the respondents.

7.Therefore, considering the way in which the matters have been dealt with by the petitioner and due to efflux of time, there will be no useful purpose, to go into the merits of the matters as the Writ Petitions have been filed only to Page No:2/4

quash the notification dated 29.06.2007, issued to fill up the post of Lecturer in Architectural Assistanship vide No.A/2/2/1/PIPMATE/A1/2007 /Part File-I. Therefore, this Court is not inclined to allow the miscellaneous petitions. Accordingly, the Miscellaneous Petitions are dismissed. 01.06.2023 Jer Page No:3/4
