Respondents Prayer: This Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 15.04.2025 and to remove the TASMAC Shop No.7484 situated at Mettur Main Road, Kolathur Village, Mettur Taluk, Salem District.

ORDER

This writ petition has been filed seeking direction to the respondents to consider the petitioner's representation dated 15.04.2025 and to remove the TASMAC Shop No.7484 situated at Mettur Main Road, Kolathur Village, Mettur Taluk, Salem District.

2. Mr.M.Sekar, learned Standing Counsel takes notice on behalf of the respondents 1, 4 and 5. Mr.P.Balathandatyutham, learned Special Government Pleader takes notice on behalf of the respondents 2, 3, 6 and 7.

2. By consent of the parties, the main Writ Petition is taken up for disposal at the time of admission stage itself.

3. The learned counsel for the Petitioner submitted that the petitioner is 9th ward Councilor of Kolathur Village, Salem District. He further submitted that the TASMAC in shop No.7484 is situated at Mettur Main Road, Kolathur Village, Salem District and the above shop is situated near to the Kolathur bus stand and there is no bar and parking facilities to the said shop. That apart, just 10 meters from the above TASMAC shop VAO Office and D.V.Hospital is situated and within 100 meter radius Block Development office, Agricultural Office, Revenue Inspector Office are all situated. Since there is no bar and parking facilities, the customers of the TASMAC shop used to park their vehicles in the Mettur main road itself for purchasing liquor, which causes traffic hindrance. In this regard, the petitioner submitted a representation to the 3/7

respondents on 15.04.2025 praying to remove the above TASMAC shop. As the same did not evoke any response,the petitioner has come forward with this writ petition seeking for the aforesaid relief.

5. The learned standing counsel appearing for the respondents has stated no objection for disposing of the representation of the petitioner.

In view of the limited scope of relief sought for in this writ petition and also in view of the submissions made by the learned counsel appearing on either side, this Court without going into the merits of the case, directs the respondents concerned to consider and pass orders on the representation of the petitioner dated 15.04.2025 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.

7. With the above directions, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 03.07.2025 Speaking/Non-speaking order Index : Yes / No 4/7
