ORDER

This petition is filed by the petitioner seeking extension of time by three months for paying the balance amount of Rs.4,71,010/- (Rupees Four Lakh Seventy One Thousand and Ten) only.

2. The petitioner earlier challenged the proceedings issued under Sections 14-B and 7 Q of the EPF & MP Act, 1952, by the respondents 1 and 2 by filing the above writ in W.P.No.9410 of 2021. The writ petition was disposed of by this Court, vide order dated 09.07.2024, on the following terms: "7.Considering the submissions made by both sides and on perusal of the records, this writ petition is disposed of and the petitioner is permitted to pay the balance of amount to the respondents as quickly as possible not later than three months from the date of receipt of a copy of this order, failing which the respondents are at liberty to intimate further action against the 2/6

petitioner without giving any notices in respect of the balance of the amount."

The learned counsel for the petitioner states that pursuant to the order of this Court, an amount of Rs.10,00,000/- (Rupees Ten Lakhs) was deposited and due to financial constraint, the remaining amount could not be paid. The learned counsel for the petitioner submits that the delay in payment was solely due to the severe financial constraints faced by the petitioner and therefore prayed that time for payment of the balance amount of Rs.4,71,010/- may be extended by three weeks.

4. The learned counsel for the respondents opposed the request for extension of time.

5. Heard both sides and perused the materials placed on record.

Considering the fact that the petitioner has paid a substantial amount of Rs.10,00,000/- (Rupees Ten Lakhs) out of Rs.14,71,010/- and that Rs.4,71,010/- (Rupees Four Lakh Seventy One Thousand and Ten) is only outstanding, this Court is inclined to extend the time by three weeks to enable the petitioner to 3/6

pay the balance amount of Rs.4,71,010/- (Rupees Four Lakh Seventy One Thousand and Ten). It is made clear that, if the petitioner does not pay the amount within extended period of three weeks from today, the respondents would be at liberty to take further action, for recovery of the balance amount.

This petition is accordingly allowed.
