ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.
2. The present writ petition, styled as public interest litigation, under Article 226 of the Constitution of India has been filed seeking direction to respondents 1 to 6 to retrieve the lands comprised in Survey Nos.298/1, 299/1 and 300 situated at Akkarapakkam Village, Uthukottai Taluk, Tiruvallur District, which are earmarked as Meikkal Poramboke in the revenue records from an encroachment made by the private respondent.
3. Learned Government Advocate, on instructions, submitted that the second respondent has already initiated enquiry and in the said proceedings, all concerned shall be put to notice and their objections shall be invited and thereafter the authority shall take a final decision and pass a reasoned order.
4. In view of the aforesaid statement made by learned Government Advocate, the writ petition is disposed of with a direction to the second respondent to issue notice to all concerned, including the petitioner, and pass a reasoned and speaking order, as expeditiously as possible, of course after affording them an opportunity of hearing.
There shall be no order as to costs.
