W.M.P.No.22212 of 2022 in W.P.No.18845 of 2010 J. NISHA BANU, J.

This petition has been filed to recall the order passed in W.P.No.18845 of 2010 dated 10.10.2014.

2. Learned counsel for the petitioner brought to the notice of this Court that in the order passed by this Court, dated 10.10.2014, the facts of the case is not connected with the present case and therefore, he filed a petition to modify the order of this Court in W.M.P.No.6832 of 2020. However, this Court, by order dated 16.08.2022 had dismissed the said petition with liberty to the petitioner to file a fresh petition to recall the order dated 10.10.2014. Hence, the present petition is filed to recall the order passed in the writ petition.

3. Learned Government Advocate appearing for the respondents would also ascertain that the order passed by this Court in W.P.No.18845 of 2010 is not pertaining to the facts of the present case and a mistake has been crept in and the same has to be rectified. He would therefore, submit that he has no objection in allow this petition.

4. Considering the submissions made on either side, this petition is allowed. The order passed by this Court in W.P.No.18845 of 2010 dated 10.10.2014 is hereby recalled.
