This Writ Petition is filed to issue a Writ of Mandamus, directing the respondents 1 to 5 to pass orders on the representation / objection submitted by the petitioner dated 12.05.2025 and to consider the 2/6
petitioner for promotion in the existing vacancy to the post of P.G.Assistant (Tamil) in the 5th respondent school in accordance with Rule 28(2) of Tamil Nadu Recognised Private Schools (Regulation) Rules 2023 based on the meritorious service rendered by the petitioner from the date of appointment on 14.08.1989 with all consequential and other attendant benefits, within a time frame to be fixed by this Court.
2. The learned Senior Counsel for the petitioner would submit that in pursuance of the order of this Court in W.P No.2680 of 2015, the petitioner preferred an appeal before the second respondent on 24.08.2022 and such appeal is yet to be considered by the second respondent.
3. At this juncture, the learned Government Advocate appearing for the respondents 1 to 4 would submit that they would consider the appeal dated 24.08.2022 within a reasonable time.
4. In such view of the matter, without going into the merits of the case, this Court deems it appropriate to direct the second respondent to 3/6
consider the petitioner's appeal dated 24.08.2022, after giving due notice to the 5th and 6th respondents and pass appropriate orders on its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
