Executive Engineer And Ado v. A. Sheik Kadhar Ali

2023-07-31Honourable Mr Justice V. Lakshminarayanan1 pages

C.M.P.Nos.19489, 19491, 19492 & 19493 of 2021 in CRP.(NPD)Nos.699, 700, 701 & 702 of 2017 V.LAKSHMINARAYANAN , J.

These Civil Miscellaneous Petitions have been filed for the purpose of re-calling an order dated 01.09.2021 made in CRP.Nos.699, 700, 701 & 702 of 2017.

2.The question of re-calling an order does not arise because the civil revision petitions were dismissed for default on the ground that the then learned counsel appearing for the Board had reported no instructions. Hence, the Court had no other option than to dismiss the revisions for default. I do not want to dismiss the petitions on this technical ground. I treat these applications as an application under Order 41 Rule 19 of CPC.

3.I am satisfied with the reasons stated in the affidavits filed in support of these petitions. Hence, these civil miscellaneous petitions are ordered.
