O R D E R

The petitioner herein seeks a direction to the respondents to survey his land situated in S.No.319/2A2A measuring 1.21 acres (49.04 ares) at S.Ayampalayam Village, Sulur Taluk, Coimbatore District by considering his application made in Application No.2024/0123/12/000/584 dated 22.01.2024 and fix the boundaries of the above said land.

2. It is the case of the petitioner that he is owner of the land measuring an extent of 1.21 acres comprised in S.No.319/2A2A situated at S.Ayampalayam Village, Sulur Taluk, Coimbatore District. The petitioner claims right over the said property under a Partition Deed dated 26.02.1990. He submitted an Application No.2024/0123/12/000/584, dated 22.01.2024 seeking survey of his land and the same has not been considered by the respondents till date. Therefore, the petitioner is before this Court. 2/4

3. Mr.A.Selvendran, learned Special Government Pleader, who is taking notice for the respondents would submit that the application of the petitioner dated 22.01.2024 will be considered by the 2nd respondent on its own merit within the time fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the 2nd respondent to consider the application of the petitioner in Application No.2024/0123/12/000/584, dated 22.01.2024 and pass final orders on its own merit, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition stands disposed of. No costs.
