[Order of the Court was made by R.SURESH KUMAR, J.] This civil miscellaneous petition has been filed to condone the delay of 146 days in filing the above writ appeal. The reason for such delay has been explained by the petitioner in the affidavit filed in support of this petition especially in Para 4 of the affidavit dated 27.07.2023.

2. Heard Mr.N.R.R.Arun Natarajan, learned Special Government Pleader for the petitioner.

3. Dr.A.E.Chelliah, learned Senior Counsel for Mr.Ahmed Rhilah and M/s.K.Ramanujam for the respondent, who stoutly opposed this petition.

4. We, after hearing the learned counsel for both sides, are inclined to allow this petition. Accordingly, this petition is ordered and the delay is condoned.

5. Registry is directed to number the appeal and place the same for admission, if the papers are otherwise in order.
