The above Miscellaneous Petition has been filed for issuance of a direction to the respondents to permit the selected students to write the Third Semester Examination of the second year to be held in the month of October 2016 (Practical and Theory) or any other subsequent date as per the selection list prepared by the petitioner pursuant to the order dated 21.05.2015 passed by this Court in M.P.No.1 of 2015 in W.P.No.14891 of 2015, pending disposal of the Writ Petition.

2. Heard Mr.L.Rajah, learned Senior Counsel, assisted by Mr.S.Dhayaleswaran, learned counsel appearing for the petitioner.

The learned Senior Counsel appearing for the petitioner pointed out that earlier orders have been passed in the Miscellaneous Petitions, dated 14.10.2015, and 07.03.2016, permitting the batch of students to write the First Semester Examination as well as the first year Final Semester Examination and now, they seek for permission to write the Third Semester Examination to be held in October 2016.

4. It is further seen that in another Writ Petition in W.P.No.17694 of 2016, the petitioner has challenged an order passed by the AICTE, dated

24.04.2016, with regard to refusal to grant extension of approval for the Academic Session 2016-2017. In the said Writ Petition, an interim order has been granted on 09.06.2016. It is submitted by the learned Senior Counsel that though interim order was granted, they have not admitted students, as they do not want the students to be exposed with problem when they seek permission for writing examinations.

Considering the earlier interim orders passed in this Writ Petition, there will be a direction to the respondents to permit the selected students to write the Third Semester Examination to be held in October 2016, both practical and theory Examinations, subject to the final result in the Writ Petition.

6. With the above observations, the above Writ Miscellaneous Petition is disposed of.
