ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 26.09.2021 for the alleged offences punishable under Section 395 and 397 of IPC, in Crime No.328 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused robbed a sum of Rs.30,00,000/- from the defacto complainant. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the petitioner is a college student and he has not committed any offence as alleged by the prosecution and only based on the confession of co-accused, he has been implicated in this case. Therefore, he prays for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) submits that the petitioner along with other accused robbed a sum of Rs.30,00,000/- from the defacto complainant, out of which, Rs.19,40,000/- has been recovered. Hence, he vehemently opposed for grant of bail to the petitioner.

5.Considering the gravity of the offence committed by the petitioner and the stolen amount was not fully recovered, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 29/10/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
