2. Heard the learned counsel for the petitioner/appellant. Though the first respondent/claimant has been served with notice, he has not entered appearance.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 88 days in filing the above appeal in C.M.A.Sr.No.93870 of 2022 is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
