The petitioner, who was arrested and remanded to judicial custody on 04.08.2022 for the offences punishable under Sections 354, 376, 406, 420 & 506(i) of IPC in crime No.506 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on the pretext of marriage, the petitioner had physical relationship with the de-facto complainant and thereafter, refused to marry her. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that he is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that there are totally 4 accused persons, in which the petitioner is arrayed as A1. The de-facto complainant and the petitioner are law students. They had love affair and subsequently, on false promise
they had sexual intercourse. Now, the petitioner is refusing to marry her and had also compelled her to abort her pregnancy. In fact, the petitioner had also taken the nude photographs of the victim girl and threatened to post the same in the social media. Thereby, he also received a sum of Rs.3,00,000/- from the de-facto complainant. Hence, he vehemently opposed to grant bail to the petitioner.
5. Therefore, the petitioner has committed very serious and heinous offence as against the woman and this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
