PRAYER The Writ Petitions filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent by considering the representation of the petitioner dated 07.03.2024 and pass appropriate orders within a time frame to be stipulated by this Court, so as to issue the community certificate to the petitioner as belonging to Hindu Kurumans Schedule Tribe Community.

COMMON ORDER (Order of the Court was made by J.NISHA BANU, J.) These writ petitions are filed for a Mandamus directing the respondent to consider the representation of the petitioners dated 07.03.2024 and to pass appropriate orders within a time frame to be stipulated by this Court, so as to issue the community certificate to the petitioners as they belong to Hindu Kurumans Schedule Tribe Community.

2. According to the writ petitioners, they belong to Hindu Kurumans Schedule Tribe Community. The petitioner's father had already contested and elected to the post of Village Panchayat under the quota reserved for Scheduled Tribe. The petitioner in W.P.No.24798 of 2015, namely P.Kalaiyarasi also had contested to the post of President of the Village Panchayat under the quota reserved for ST community. The petitioners, based on documentary evidence available to prove that they belong to Hindu Kurumans Schedule Tribe Community, have submitted a representation dated 07.03.2024 to the respondent seeking issuance of ST Community Certificate, however their representation did not evoke any any kind of response and therefore, they are constrained to file these writ petitions.

3. Heard the learned counsel for the parties.

4. Considering the limited scope of prayer sought for by the petitioners, this Court, without expressing anything on merits, directs the respondent to consider the representation of the petitioners dated 07.03.2024 by affording opportunity to the petitioners and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
