The petitioners, who were arrested and remanded to judicial custody on 26.07.2022 for the offences punishable under Sections 328 of IPC read with Section 20(1) of Cigarette and Tobacco Products Act, 2003 in Crime No.201 of 2022, seeks bail.
2. The case of the prosecution is that the petitioners along with other accused were found in possession of 1,650 kgs of banned tobacco products. Hence, the case.
3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. That apart, the petitioners have been suffering incarceration from 26.07.2022. Hence, he prays for grant of bail to the petitioners. https://www.mhc.tn.gov.in/judis

The learned Additional Public Prosecutor appearing for the respondent would submit that, the total quantity of the tobacco products involved in this case is 1650 kg and it is worth about Rs.25,00,000/- and the investigation is at preliminary stage. Hence, he vehemently opposed to grant bail to the petitioners.
5. Considering gravity of the offence committed by the petitioners, this Court is not inclined to grant bail to the petitioners.
