2. In the light of the narrative thus far, considering the trajectory which the matters are taking and taking into account the position that Section 34 Court has allowed Section 34 petitions and set aside the impugned awards, we deem it appropriate to dispose of the captioned CMPs as closed. We make it clear that we have not expressed any view or opinion on the merits of the matter and we also make it clear that all rights Page Nos.1/3

and contentions of the petitioner / contractor are preserved for resuscitating same / similar prayer by filing separate CMPs, if the need arises depending on the trajectory the matter takes and further developments / change in circumstances.

3. Captioned CMPs disposed of in the aforementioned manner. There shall be no order as to costs.
