This Criminal Original Petition has been filed by the petitioners/A1& A2, who were arrested and remanded to judicial custody on 18.12.2023, seeking bail in Crime No.764 of 2023 registered for the offence under Sections 392 & 397 of IPC.
2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners, who were no way connected with the alleged offence, has been suffering incarceration from 18.12.2023. Hence, he prayed to grant bail to the petitioners stating that they are ready to abide by any stringent conditions that may be imposed by this Court.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the petitioners had trespassed into the house of the de facto complainant and by threatening the de facto complainant and his wife at knife point, robbed two mobile phones, a cash of Rs.10,500/- and a bike from them. He further submitted that the investigation in this case has been completed and the charge sheet has also been filed, however, there is no recovery from the accused. He also submitted that 8 previous cases are pending against these petitioners, therefore, if they are released on bail, there is every possibility of them absconding and not available for trial proceedings and would also threaten the witnesses. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that no recovery was made from the accused and also considering the gravity of the offence committed by the accused and their antecedents, this Court is not inclined to grant bail to the petitioners.
