O R D E R

This writ petition has been filed questioning the Look Out Circular issued by the second respondent dated 02.01.2024.

2. The case of the petitioner is that he was married to the third respondent on 03.01.2018. There was some dispute which resulted in the petitioner filing a divorce petition before the Family Court, Coimbatore, in IDOP No.446 of 2019. The third respondent initiated proceedings under the Domestic Violence Act and also sought for maintenance under Section 125 Cr.P.C. Apart from that, the third respondent also lodged a complaint against the petitioner before the first respondent and the same was acted upon and a First Information Report was registered in Crime No.32 of 2022 for offence under Section 498-A IPC. The investigation was completed and a police report was filed before the Additional Mahila Court, Coimbatore and the same is pending in C.C.No.207 of 2025. In the mean time, the first respondent gave a requisition to the second 2/4

respondent and based on the same, the second respondent has issued the Look Out Circular, which is pending.

3. The petitioner filed an anticipatory bail petition in Crl.M.P.No.1515 of 2025 before the District and Sessions Judge, Coimbatore and anticipatory bail was also granted. In spite of the same, the Look Out Circular is pending before the second respondent and as a result, the petitioner is not able to continue with his job at Abu Dhabi. It is under these circumstances, the present writ petition has been filed before this Court.

When the matter was taken up for hearing, learned Government Advocate [Crl.side] appearing on behalf of the first respondent, on instructions, submitted that the case is pending in C.C.No.207 of 2025 on the file of Additional Mahila Court, Coimbatore and the petitioner has already been granted anticipatory bail.

5. In the considered view of this Court, the case in hand does not require a Look Out Circular against the petitioner since it is only a matrimonial dispute. Therefore, there shall be a direction to the first 3/4

N.ANAND VENKATESH, J gm respondent to immediately address a communication to the second respondent and withdraw the request made for issuing Look Out Circular. On receipt of the requisition from the first respondent, the Look Out Circular shall be immediately withdrawn. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above direction. No costs.
