Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider and pass orders on the petitioner's representation dated 03.09.2017 with regard to inclusion of petitioner name in the promotional panel dated 19.01.2017 within a stipulated time as fixed by this Hon'ble Court.

O R D E R

The prayer sought for is to direct the respondent to consider and pass orders on the petitioner's representation dated 03.09.2017 with regard to inclusion of his name in the promotional panel dated 19.01.2017 within a stipulated time as fixed by this Hon'ble Court.

2. The case of the petitioner is that he was initially worked as Contract labour at Mettur Thermal Power Station from 1981 to 1995 on consolidated basis. Thereafter the petitioner was appointed as a Helper on 11.10.1995 and promoted as Assistant Operator in the year 2000 and posted in Tunnel Power House Electrical Mettur. He was promoted as a Crane Operator in the year 2012. Thereafter further promotion as Foreman Grade-II in the month of October 2014. Foreman Grade-I for which 8th standard pass is the required qualification. But the petitioner had not studied 8th std.

The petitioner made a representation on 03.09.2017 to the respondent to include his name in promotion panel since the Qualification has been relaxed as per the 18 (1) Settlement, but till date his representation was not considered by the respondent. Aggrieved by the same, the petitioner has filed the above Writ Petition.

4. The learned counsel for the petitioner would submit that it would be suffice to issue directions to the respondent to dispose of the representation in accordance with law.

5. Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the respondent to dispose of the representation dated 03.09.2017, if not disposed already within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
