Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents from proceeding with the construction of toilet for the 4th respondent school adjoin to the house of the petitioner existing at No.39 and 40, 2nd Street, Kamaraj Nagar Colony, Salem-14 by considering the representation of the petitioner herein dated 12.10.2021.

ORDER

This writ petition has been filed for the issue of a writ of Mandamus directing the respondents to consider the representation made by the petitioner on 12.10.2021. The petitioner has objected to the construction of toilet by the fourth respondent adjoining the residential premises belonging to the petitioner.

2. Heard Mr.R.Nalliyappan, learned counsel for the https://hcservices.ecourts.gov.in/hcservices/

petitioner and Mr.A.Selvendran, learned Government Advocate appearing for the respondents.

3. Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the second respondent to consider the representation made by the petitioner on 12.10.2021 on its own merits and in accordance with law and shall take a decision within a period of two weeks from the date of receipt of a copy of this order. The petitioner shall make a fresh representation along with a copy of the representation dated 12.10.2021 and also a copy of this order.

With the above directions, this writ petition is disposed of. No costs.
