By consent, the writ petition is taken up for final disposal.
The petitioner and her husband had availed a Housing Loan amounting to a sum of Rs.20 lakhs during the year 2009 from the respondents -Canara Bank and the repayment is fixed in the form of equated monthly instalments for the first 12 months as 8%, for the next 48 months as 9% and for the next 180 months as 10% assigning it under Base Prime Lending Rate [BPLR] Scheme and to the shock and surprise, all of a sudden, without putting the petitioner and her husband on notice, it has been changed to Base Rate Concept and in this regard, the petitioner and her husband, submitted a representation on 25.04.2016 to the 2nd respondent and also approached the Banking Ombudsman and the said authority had closed the complaint dated 03.05.2016. The petitioner, in this regard, has also submitted yet another representation dated 12.05.2016 to the respondents and since no response is forthcoming she came forward to file the present writ petition. https://hcservices.ecourts.gov.in/hcservices/
This Court heard the submissions of the learned counsel for the petitioner and also perused the materials placed before this Court.
This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the 2nd respondent to consider and dispose of the petitioner's representations dated 29.04.2016 and 12.05.2016 respectively, on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to her husband.
The writ petition is disposed of accordingly. No costs.
