This petition has been filed to modify the condition imposed on the petitioners that each of the petitioners shall deposit a sum of Rs.2,00,000/- to the credit of Crime No5/AC/2022 before the concerned Magistrate within a period of three months from the date on which the order copy made ready in Crl.M.P.No. 6262 of 2023 in Crl.O.P.No.1046 of 2023 dated 27.04.2023.

2. The learned counsel for the petitioners submitted that they could not mobilise the fund and they are having commitments for paying loans. So, they do not have financial capacity to deposit the amount as directed by this court. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioners in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.1,50,000/- (Rupees one lakh fifty thousand only) to the credit of Crime No.5/AC/2022 before the concerned Magistrate within a period of three weeks from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 1046 of 2023 vide order dated 19.01.2023 shall remain unalterted.
