This Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.3539 of 2023 by order dated 27.02.2023.

2. The learned counsel for the petitioners submitted that for about one year the petitioners were in judicial custody in spite of bail being granted to them, since, they were not able to deposit the amount as ordered by this Court. As they have no source of income to that effect, this Court already directed the Prosecutor to verify whether they are having any immovable property.

3. The learned Government Advocate (Crl.Side) submitted that on verification they found that the petitioners have no immovable property. 1\3

4. The petitioners are Senior citizens and they are under judicial custody for 357 days. Final report is also filed and the case is taken up on the file of the Chief Metropolitan Magistrate, Egmore, Chennai, assigned in C.C.No.1610 of 2023.

5. Since the petitioners are Senior Citizens, and not having property to deposit the amount in Crime No.112 of 2021, the petition is allowed. The petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the Chief Metropolitan Magistrate, Egmore, Chennai. In other respects, the order dated 27.02.2023 shall remain unaltered. 14.09.2023 rri 2\3
