O R D E R

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner has assailed the impugned order passed by the Tamil Nadu Information Commission under RTI Act, 2005 in terms whereof, the information sought for by the respondent was answered except qua making available the certified copy of the order in a disposed of writ petition. In terms of the impugned order, that has been directed to be supplied.

2. The petitioner has no inherent objection to supplying a copy of the judgment, but since the respondent is not a party to the proceeding, copy of the judgment can be obtained on payment of requisite charges in terms of Rule 3 of Order XII of the Appellate Side Rules, which reads as under:- https://hcservices.ecourts.gov.in/hcservices/

"R.3. Any person who is not a party to a proceeding, requiring copies of judgments, decrees or orders made or of any documents filed or exhibited in such proceeding, may apply to court for grant of such copies by a duly stamped petition."

Thus, what the petitioner states is that the respondent may obtain the certified copy in terms of the rules.

3. We find merit in the aforesaid contention, as the procedure is prescribed in the rules itself for obtaining certified copy of the judgment and to that extent, the impugned order is set aside with liberty to the respondent to obtain the certified copy in accordance with the rules.
