J.
The petitioner namely Raviganesh, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 498-A, 354 A(1)(i) r/w 34 of IPC in Crime No.6 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.When the matter is taken up on 23.08.2023, this Court, on the undertaking given by the learned counsel for the petitioner, directed the petitioner to produce his mobile phones (1+ Nord Blue colour bearing No.9629999253 and 1+ Nord Black colour bearing No.9489963500) to the respondent police for the purpose of investigation. On compliance on that condition, this Court had granted interim anticipatory bail to the petitioner on 07.09.2023, with a view to facilitate the mediation efforts. It is now informed that the mediation has failed.
3.Learned counsel for the petitioner prays to make the interim anticipatory bail as absolute, on the ground that, the report received from the Forensic Science Laboratory, Puducherry does not reveal anything incriminating against the petitioner.
4.In response, learned Government Advocate (Puducherry) opposed
this petition, on the ground that, there are certain obscene contents and objectionable audio files available, as per the report of the Forensic Science Laboratory.
5.Learned counsel for the defacto complainant/intervenor also objects to make the interim anticipatory bail as absolute. 6.Considered the rival submissions and perused the records. 6.1.It is seen from the submissions of the learned counsel for the parties, the allegations against the petitioner is that, he had indulged in rough sexual relationship with the defacto complainant and took videos of intimate relationship and then threatened to use it against her. Therefore, on the instructions of this Court, the cell phones used by the petitioner had been analysed by the Forensic Science Laboratory. On analysing the report, this court could see in Column No.7 (g) that "The media files stored/retrieved were found available along with obscene images related to the internet contents." 6.2.On going through the analysis report, this Court does not find any
findings, regarding the submission of the defacto complainant that rough sexual relationship between the petitioner and defacto complainant was recorded and available in the cell phone of the petitioner. Learned Government Advocate (Criminal side) was also not able to show this Court any such findings. 7.In such circumstances, this Court makes the interim anticipatory bail granted to the petitioner as absolute as per the conditions imposed on 07.09.2023 with a modification that the petitioner shall report before the respondent police as and when required for interrogation. 8.With the above modification, this Criminal Original Petition is disposed of.
