J U D G M E N T
(Judgment of the Court was delivered by C.Kumarappan J.) The present Writ Petition has been filed, challenging the order of learned Single Judge dated 07.09.2023 made in W.P.No.5093 of 2018.
2. Brief facts, which are necessary for disposal of the case are that the Workman / petitioner / appellant herein raised an industrial dispute in pursuance of the reference dated 02.12.2011. Learned Central Government Industrial Tribunal-cum-Labour Court, Chennai has granted reinstatement to the Workman without backwages, but with continuity of service. Aggrieved by the same, the Workman / Appellant herein had filed a Writ Petition, which was dismissed by the learned Single Judge on 07.09.2023. Challenging the Writ Court's order, the petitioner / appellant herein is before this Court.
3. Learned counsel for the appellant would submit that though the Workman is aggrieved by the Award of Tribunal as well as the order of Writ Court, the only grievance of the Workman now is that he is not seeking for any backwages and what he seeks is continuity of service, as awarded by the Labour Court.
4. In view of the fair submission made by the learned counsel for the appellant in confining his prayer only to the extent of continuity of service, we deem it appropriate to clarify the order of the learned Single Judge dated 07.09.2023, is nothing but confirming the award of the Labour Court. Hence as ordered by the Labour Court, the appellant becomes eligible for continuity of service.
5. Since the appellant is accepting the award, wherein the relief of continuity of service is granted, no further adjudication on merits needs to be undertaken.
