The present criminal original petition has been filed to transfer the investigation of the case in Crime No.406 of 2007 from the file of the fourth respondent to the second respondent so as to conduct fair investigation.
2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that the case in Crime No.406 of 2007, after completion of investigation, was referred as 'Mistake of Fact' vide RCS No.15 of 2008 dated 11.10.2008.
