The petitioner namely Gowtham Kumar, who was arrested and remanded to judicial custody on 23.06.2023 for the offences punishable under Sections 406 and 420 IPC in Crime No.89 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No. 89 of 2023 for the offences under Sections 406 and 420 IPC. Petitioner is in judicial custody from 23.06.2023. Petitioner is innocent. Thus, he prays for grant of bail.

3. Learned Additional Public Prosecutor opposes this petition, on the ground that, petitioner contacted the defacto complainant and informed him that, there is a job opportunity for him at Caterpillar Company and got his bio-data and Rs.50,000/-. One Balakrishnan introduced him claiming himself as if he is working at Caterpillar Company. Wilson, Paulraj, Ramprasad and Balakrishnan conducted interview to the defacto complainant. On their promise, defacto complainant paid a sum of Rs.13,00,000/- to the petitioner through bank 1/3

transaction. However, defacto complainant was neither given employment at Caterpillar, nor his amount was repaid. Investigation in this case is not completed. Therefore, he prays for dismissal of this bail petition.

4. Considering the nature of the offence alleged to have been committed by the petitioner and that the amount is not recovered and that investigation in this case is not completed, this Court is not inclined to release the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed. 07.08.2023 gd 2/3
