The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 384, 297 and 506(ii) of IPC r/w Section 3(1) of TNPPDL Act, 1992 in Crime No.3130 of 2021, seeks anticipatory bail.

2. The learned counsel for the petitioner would submit that an FIR was registered against the petitioner in Crime No.3130 of 2021. Upon completion of the investigation, a final report was filed, and the case has been taken on file as S.C.No.481 of 2025 on the file of the IV Additional District and Sessions Court, Ponneri, where it is now pending for trial. It is stated that, due to viral fever, the petitioner was unable to appear before the Trial Court on 24.02.2026, as a result of which a Non-Bailable Warrant came to be issued against him.

3. The learned Government Advocate (Crl.Side), for the respondent would submit that the petitioner was aware of the proceedings and he had appeared before the learned District Judge on summons, and thereafter failed to appear before the Court.

4. I have given my anxious consideration to either side submissions.

From the submissions made by the learned counsel appearing on either side, it is seen that the present petition has been filed seeking anticipatory bail in respect of the Non-Bailable Warrant issued against the petitioner on 24.02.2026. According to the learned Government Advocate (Crl.Side), the petitioner is a history-sheeter. Be that as it may, this Court does 2/4

not find any reason to entertain an application for anticipatory bail in a case where a Non-Bailable Warrant has been issued on account of the petitioner's absence before the Trial Court. Accordingly, this Court is not inclined to grant anticipatory bail to the petitioner.
