ORDER : The Court Made the following order :- The petitioner who was arrested on 19.09.2021 for the offence under Section 302 of I.P.C. in Cr.No.561 of 2021 on the file of the respondent police, seeks bail.

2.It is the case of the prosecution that the petitioner along with the other accused is alleged to have committed murder of the deceased.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that there is no specific overtact as against the petitioner and that the petitioner is a chronic diabetic patient and is also suffering from heart ailments and would further submit that the petitioner is in prison from 19.09.2021.

4.The learned Government Advocate (Crl. Side) would submit that the petitioner is arrayed as A2 in the case. A1 is the wife of the deceased. A1 and A2 had illegal intimacy and when the deceased saw A1 in the inhabited condition, quarrel arose and the accused committed murder of the deceased. He would further submit that investigation is in preliminary stage and vehemently opposed for grant of bail to the petitioner.

5.Considering the fact that the investigation is in preliminary stage; the offence committed by the petitioner is heinous offence and since investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner.
