ORDER : The Court Made the following order :- The petitioners, who apprehend arrest for the alleged offence punishable under Sections 294(b), 323, 506(ii) of IPC, in Crime No.291 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioners tried to prevent the local temple festival and thereby abused the defacto complainant in filthy languages. It is further alleged that the petitioners attacked the defacto complainant, due to which the defacto complainant sustained injuries. Based on the complainant lodged by the defacto complainant, the Law Enforcing Agency registered a case against the petitioners.
3.The learned counsel appearing for the petitioners submits that the petitioners have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. 4. The learned Government Advocate (Crl.Side) submits that there are five previous cases similar in nature pending against the petitioners. Hence, he vehemently opposed for grant of anticipatory bail to the petitioners.
5. Considering the allegation level against the petitioners and also considering that there are five previous cases similar in nature pending against petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
