ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 323, 506(ii) of IPC in Crime No.291 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons tried to prevent the local temple festival and thereby abused the defacto complainant in filthy language and also attacked the defacto complainant with hands and caused injuries. Hence, the complaint.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) submitted that the petitioner along with other accused persons tried to prevent the local temple festival and thereby abused the defacto complainant in filthy language and also attacked the defacto complainant with hands and caused injuries. He further submitted that there are five previous cases pending against the petitioner and co-accused anticipatory bail application was dismissed by this Court in Crl.O.P.No.20553 of 2021 dated 01.11.2021. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and also the fact that there are five previous cases pending against the petitioner and the co-accused anticipatory bail application was dismissed by this Court, this Court is not inclined to grant anticipatory bail to the petitioner.
