These Criminal Original Petitions have been filed by the petitioners, who were arrested and remanded to judicial custody on 17.06.2024, seeking bail in Crime No.361 of 2024 registered for the offence punishable under Sections 147, 149 & 302 of IPC.

2. Learned counsel appearing for the petitioners submitted that the petitioners are the innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are no way connected with the alleged offence and they have been unnecessarily arrayed as accused in this case. He also submitted that the de facto complainant's son was murdered by some other persons, whereas, the petitioners have been made as scape goat and they are suffering incarceration from 17.06.2024, hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that, due to the previous enmity, the petitioners, who are arrayed as A4 & A5, along with other accused had murdered the de facto complainant's son, by assaulting him with knife. He further submitted that the case is under investigation and therefore, if the petitioners are released on bail at this stage, there is every possibility of them absconding and not available for further investigation. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the case is under investigation and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioners.
