ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 5(1) and 6 of Protection of Children Sexual Offences Act 2012, in Crime No.25 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant are distance relatives and had a love affair and they used to go to several places and were also having physical relationship. But, the petitioner refused to marry the de facto complainant. The petitioner misusing the relationship, gave torture to the defacto complainant. Hence, the law enforcing agency registered a case as against the petitioner.

3.The learned counsel for the petitioner submitted that the petitioner and the defacto complainant are relatives and loved each other. Now the defacto complainant attained 18 years and due to ill advice of the parents only this complaint was lodged by the defacto complainant before the respondent police. He would further state that the petitioner has nothing to do with the alleged offences and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor submitted that the 164 statement of the victim has been recorded and the investigation is at earlier stage. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the above fact and circumstances of the case and the nature of allegations against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
