By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the Respondents herein to consider the representation dated 23.06.2025 of the petitioner and accordingly post the petitioner in any of the available vacancies closest to Krishnagiri District by considering the fact that the petitioner belongs to priority category under the spouse category and that the petitioner's wife is working in Krishnagiri District.
3. Heard the learned counsel for both sides and perused the materials 2/6
available on record.
4. The learned Senior Counsel appearing for the petitioner would submit that the petitioner was originally appointed as Assistant Inspector in the year 2010 and subsequently, he was promoted as Inspector in the year 2018 and posted at Office of the Assistant Director, Local Fund Audit Dharmapuri. Thereafter, the petitioner was transferred to Chennai. The learned Senior Counsel appearing for the petitioner though had fairly admit that the transfer is incidents of services, only grievance urged before this Court is that inspite of the guidelines dated 16.06.2025, the petitioner was transferred to faraway place to Chennai and that the petitioner is having two children and his wife is working at Krishnagiri. Therefore, it is the submission of the petitioner that he may be considered for a nearer place such as Erode and Vellore.
5. At this juncture, the learned Additional Government Pleader appearing for the respondents would strongly object the contention of the petitioner and would contend that the guideline dated 16.06.2025 has been issued to maintain a transparency and the same will not have any force of 3/6
statute. At this juncture, the learned Additional Government Pleader would further submit that since the petitioner's representation is pending with them, they would consider the same according to it's own merits.
6. In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 23.06.2025 and pass orders on it's own merits and in accordance with law, within a period of two weeks from the date of receipt of copy of this order.
7. With the above direction, the Writ Petition is disposed of. No costs. Consequently, the connected writ miscellaneous petition is closed. 30.06.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
