By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct second respondent to issue patta in Survey No.17/03 as per the application of the petitioner dated 26.11.2019.

It is submitted by the learned counsel for the petitioner that petitioner purchased the land comprised in Survey No.17/3, measuring an extent of 2460 sq.ft situated at Paimash No.46/4, Venkateswara Colony, Koyambedu Village vide sale deed dated 12.04.1982. It is stated that out of the 2460 sq.ft., 2.5 cents of the said property was acquired for laying Nesapakkam Road vide Award No.2 of 1992 dated 28.08.1992 and the petitioner was granted compensation for the same. The petitioner was in possession and enjoyment of the remain extent of the said property. Thereafter, the petitioner submitted an application dated 26.11.2019 to the second respondent seeking issuance of patta for the remaining extent of the said property, which was under his possession after acquisition. It is stated that enquiry was also made on the basis of the above application, and certain documents were called for and the same were produced by the petitioner. 2/5

However, patta has not been issued to the petitioner in respect of the subject property. Aggrieved by the same, the petitioner has come before this Court.

At the outset, it was submitted by the learned Additional Government Pleader for respondents that the petitioner's application dated 26.11.2019, would be considered and the entire process would be completed and appropriate orders would be passed, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the second respondent, to consider the petitioner's application dated 26.11.2019 on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, and any other interested persons/stake holders, within a period of twelve (12) weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the application and it is open to the concerned respondent to consider the application on its own merits and in accordance with law.

6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
